How is end of service calculated in Saudi Arabia?
Article 84 of the Saudi Labor Law gives every employee whose contract ends an end of service award (gratuity) based on the last wage:
- Half a month's wage for each of the first five years of service.
- A full month's wage for each year after the fifth.
- Parts of a year count proportionally.
The wage is the actual wage: the basic salary plus fixed allowances such as housing and transport.
End of service on resignation (Article 85)
| Service when resigning | Share of the gratuity |
|---|---|
| Less than 2 years | Nothing |
| 2 to 5 years | One third |
| More than 5 and less than 10 years | Two thirds |
| 10 years or more | The full gratuity |
If the employer ends the contract, the fixed-term contract expires, or both sides agree to end it, the employee gets the full gratuity. Under Article 87, it is also paid in full if the employee leaves because of force majeure, or if a female employee ends the contract within six months of marriage or three months of giving birth.
Example: a wage of SAR 10,000 (basic + allowances) and 7 years of service. The first 5 years give 5 × 5,000 = SAR 25,000 and the next 2 years give 2 × 10,000 = SAR 20,000, so the full gratuity is SAR 45,000. If the employee resigned, they get two thirds: SAR 30,000.
Does the gratuity apply to expats?
Yes. The end of service rules in the Labor Law apply to Saudi and non-Saudi employees in the private sector alike, whatever the nationality.
